These Terms of Use (the "Terms") govern your use of the websites, software tools, demonstrations, and applications published by Halal Helper LLC, doing business as Omerica Studios ("we," "us," or "our"), in New Jersey (the "Services"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Informational purpose only
The Services are provided for general information, demonstration, education, and entertainment. They are not a substitute for professional judgment, and they are not tailored to your situation. Outputs, figures, listings, deadlines, prices, and availability shown on the Services may be incomplete, outdated, or incorrect.
2. No affiliation
Unless a page states otherwise in plain terms, the Services are independently published and are not official, endorsed, sponsored, or operated by any government agency, program operator, brand, employer, or other organization named on them. Where a business, agency, or person is named, that name is used for identification, commentary, or demonstration only.
Some of the Services are unaffiliated demonstration builds created to show design and engineering work. Those are labeled on the site itself and are not operated by the business shown. See Site Disclaimers for which sites these are.
3. No professional relationship
Using the Services does not create an attorney-client, broker-client, fiduciary, medical, therapeutic, accounting, or other professional relationship between you and us. The Services do not provide legal, tax, financial, investment, insurance, real estate, medical, or mental health advice. For advice about your circumstances, consult a qualified licensed professional.
4. AI-generated and AI-assisted content
Many of the Services display, or are built from, content produced with large language models and other AI systems. AI output can contain factual errors, fabricated details, outdated information, and biased results, and can unintentionally resemble existing copyrighted or trademarked material. Review AI output before relying on it. Full details are in our AI Disclosure.
No automated decision-making producing legal or similarly significant effects is performed on visitors to the Services.
5. Prototypes and demonstrations
Many Services are prototypes, demonstrations, or experiments. Features, outputs, and results may change or disappear, and are not guaranteed to be production ready. Do not rely on a prototype as a finished professional service or as a safety, medical, navigational, or financial instrument.
6. Who may use the Services
You must be at least 18 years old, or the age of majority where you live, to use the Services, or use them with the supervision of a parent or guardian who agrees to these Terms.
7. Acceptable use
You agree not to misuse the Services, including by breaking the law, infringing the rights of others, uploading malware, attempting to gain unauthorized access, scraping or overloading the Services, or using them to harass or harm anyone.
8. Your responsibility
You are solely responsible for how you use the Services and for any decision you make based on them, including any application you submit, agreement you sign, payment you make, physical movement you attempt, or action you take or do not take. Verify all information with the original source before acting.
9. Third-party links, data, and services
The Services link to and sometimes display data from third-party websites, programs, and APIs. We do not control those third parties, do not endorse them, and are not responsible for their content, accuracy, availability, pricing, security, or privacy practices. Your dealings with any third party are solely between you and that third party.
10. Intellectual property; takedown
The Services and the software, text, and designs we provide are owned by Omerica Studios and protected by law. We grant you a limited, revocable, non-transferable license to use the Services for their intended purpose.
Third-party names, logos, and trademarks belong to their owners. If you believe material on the Services infringes your copyright or trademark, or that your name or likeness appears without your authorization, email omer@halalhelper.com with the exact URL, an identification of the material, and your contact information. We will review and, where warranted, remove the disputed material promptly, while reserving our rights.
11. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error free, or that any output, listing, deadline, or result will be accurate or complete.
12. Limitation of liability
To the fullest extent permitted by law, Omerica Studios will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of the Services, whether based in contract, tort, strict liability, or any other theory, and whether or not we were advised of the possibility of those damages.
Our total cumulative liability for all claims relating to the Services will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred United States dollars (US $100).
These limits are an essential part of the agreement between us and apply even if a limited remedy fails of its essential purpose.
13. Indemnification
You agree to indemnify and hold harmless Omerica Studios from claims, damages, losses, and reasonable costs arising out of your use of the Services or your violation of these Terms or of the law. This does not apply to the extent a claim arises from our own gross negligence, willful misconduct, or fraud.
14. Payments and refunds
Client work is performed under a signed agreement, and that agreement, not these Terms, governs pricing, deliverables, and refunds for the engagement. Where we offer online invoice payment, it is processed by Stripe on Stripe's own checkout pages; your card details go to Stripe directly and never pass through our systems. Invoice amounts are stated in United States dollars. If you believe an invoice or a charge is wrong, email omer@halalhelper.com before or after paying and we will review it promptly; nothing in this section limits your rights under your card agreement or applicable law.
15. Your consumer protections are preserved
Nothing in these Terms waives, limits, or reduces any right you have under the New Jersey Consumer Fraud Act, N.J.S.A. 56:8-1 et seq., or under any other consumer protection law that cannot be waived by agreement.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the sections above apply only to the extent permitted, and nothing here limits liability that cannot be limited by law, including liability for personal injury caused by our negligence, or for fraud.
16. Corrections and suggestions
If you find something wrong on any of the Services, please tell us at omer@halalhelper.com and we will correct it. We welcome suggestions. By sending a suggestion you agree we may use it without obligation, compensation, or confidentiality, and you should not send us anything you consider confidential or proprietary.
17. Disputes; arbitration and class-action waiver
Any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration rather than in court, except that either party may bring a claim in small claims court, and either party may seek injunctive relief for infringement or misuse of intellectual property. You and Omerica Studios waive the right to a jury trial and the right to participate in a class action.
You may opt out of this arbitration section within 30 days of first accepting these Terms by emailing omer@halalhelper.com with the subject line "arbitration opt-out." Opting out does not affect any other part of these Terms. If any part of this section is unenforceable, the rest of these Terms continues to apply. This section does not apply where it is prohibited by law.
18. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Subject to Section 16, the state and federal courts located in New Jersey will have jurisdiction.
19. Severability
If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force.
20. Changes to these Terms
We may update these Terms. Material changes take effect when we post the updated Terms and change the "Last updated" date above. Continuing to use the Services after that means you accept the change.
